How much foreign income is tax free in the US?
For the tax year 2022 (the tax return filed in 2023), you may be eligible to exclude up to $112,000 of your foreign-earned income from your U.S. income taxes. For the tax year 2023 (the tax return filed in 2024), this amount increases to $120,000.
However, you may qualify to exclude your foreign earnings from income up to an amount that is adjusted annually for inflation ($107,600 for 2020, $108,700 for 2021, $112,000 for 2022, and $120,000 for 2023). In addition, you can exclude or deduct certain foreign housing amounts.
Limit on excludable amount
For tax year 2023, the maximum foreign earned income exclusion is the lesser of the foreign income earned or $120,000 per qualifying person. For tax year 2024, the maximum exclusion is $126,500 per person.
Non-U.S. Source Income – Foreign Source Income
Nonresident aliens, for tax purposes, unlike U.S. citizens and residents, are only subject to tax on income that is considered U.S.-source income. Foreign-source Income received by nonresident aliens is not subject to U.S. taxation.
- Alaska.
- Florida.
- Nevada.

Source of Earned Income
The source of your earned income is the place where you perform the services for which you receive the income. Foreign earned income is income you receive for performing personal services in a foreign country. Where or how you are paid has no effect on the source of the income.
Wages – Wages include any income paid to you for services or goods sold. This includes if you're employed by a foreign company or if you're a self-employed contractor working in a foreign country. Interest – Interest includes money earned from a foreign bank account or a CD, for example.
Federal law requires U.S. citizens and resident aliens to report their worldwide income, including income from foreign trusts and foreign bank and other financial accounts.
The US is one of the few countries that taxes its citizens on their worldwide income, regardless of where they live or earn their income. This means that American expats are potentially subject to double taxation – once by the country where they earn their income, and again by the United States.
For individuals who are dual citizens of the U.S. and another country, the U.S. imposes taxes on its citizens for income earned anywhere in the world. 7 If you live in your country of dual residence that is not the U.S., you may owe taxes both to the U.S. government and to the country where the income was earned.
How do I claim foreign income in the US?
You must attach Form 2555, Foreign Earned Income, to your Form 1040 or 1040X to claim the foreign earned income exclusion, the foreign housing exclusion or the foreign housing deduction.
You must express the amounts you report on your U.S. tax return in U.S. dollars. Therefore, you must translate foreign currency into U.S. dollars if you receive income or pay expenses in a foreign currency. In general, use the exchange rate prevailing (i.e., the spot rate) when you receive, pay or accrue the item.
Since foreign accounts are taxable, the IRS and U.S. Treasury have a very rigid process for declaring overseas assets. Any American citizen with foreign bank accounts totaling more than $10,000 in aggregate, or at any time during the calendar year, is required to report such accounts to the Treasury Department.
According to the updated MoneyGeek analysis, the most “tax friendly” state overall was Nevada, where the median family owes about 3% of its income in taxes. Meanwhile, 13 states earned either a D or F grade for tax burdens. For some of those states, like Oregon, high personal income tax rates are to blame.
File using Form 1040.
U.S. citizens living aboard must report all worldwide income, including income earned abroad. This includes income from employment, self-employment, investments, rental properties, and any other sources of income.
Who Does Not Have to Pay Taxes? Generally, you don't have to pay taxes if your income is less than the standard deduction, you have a certain number of dependents, working abroad and are below the required thresholds, or are a qualifying non-profit organization.
Generally, to meet the physical presence test, you must be physically present in a foreign country or countries for at least 330 full days during a 12-month period including some part of the year at issue. You can count days you spent abroad for any reason, so long as your tax home is in a foreign country.
IRS Foreign Bank Account Investigations
With the IRS' increased enforcement of offshore account compliance, trust reporting and income disclosure, U.S. Taxpayers are at higher risk of penalties. The failure to properly report foreign money may result in significant fines.
Excluding Foreign Income & FATCA
Unfortunately, that same foreign income is not typically exempt in the US — and so if the FFI reports the income to the IRS, but the taxpayer did not include it on their US tax return — it could lead to an audit.
Enter the amount of the foreign earned income exclusion claimed on your 2022 federal taxes. This amount appears on IRS Form 1040 Schedule 1, line 8d.
What happens if you don't report foreign income?
The IRS penalizes both failures to report and failures to pay and the penalties for reporting violations can be substantial. With this in mind, if you have failed to report your foreign-earned income to the IRS, this is an issue you will want to address proactively—before facing an IRS audit or investigation.
If you're a U.S. citizen abroad and have never filed a tax return, you can relax. The IRS built in a safeguard for honest expats who truly didn't know they had tax filing obligation. You can get caught up penalty-free with Streamlined Filing Compliance Procedures.
- Retaining corporate earnings. You can avoid double taxation by keeping profits in the business rather than distributing it to shareholders as dividends. ...
- Pay salaries instead of dividends. You can distribute profit as salaries or bonuses instead of as dividends. ...
- Split income.
US citizens can live outside the country for as long as they wish — even for the rest of their lives — without a problem. A US citizen cannot be prevented from re-entering the US. You can stay out of the USA for as long as you'd like. You can renew passport as needed at the local US embassy or consulate.
If you are a U.S. citizen and have dual citizenship in another country, you must file taxes in the U.S. The U.S. will impose taxes on you regardless of where you live and where you earn your income. Dual citizens who are living abroad may owe taxes to both the U.S. and the country in which they earn their income.
